DECISION & REASON:

An information lodged by Stipendiary Steward Mr J Muirhead against Ms J Compain, driver of FLAUNTING THE FAITH, alleging a breach of Rule 869(3)(b) ? careless driving ? in that she drove her horse where there was insufficient room with about 100m to run causing her horse to break.

Ms Compain admitted the breach and was accompanied at the hearing by trainer, Mr S Reid.

Mr Muirhead demonstrated the incident by use of the video film. FLAUNTING THE FAITH was well back in the field and Ms Compain tried to get the horse through a gap where there was clearly insufficient room causing her horse to break.

Penalty:

Mr Muirhead said that Ms Compain was not in a position to pay a fine. He suggested a two-day suspension of her driver's licence. He produced Ms Compain's driving record, which showed one breach for careless driving in April 2006.

Mr Reid agreed with Mr Muirhead's analysis of the incident and with his recommendations. He said FLAUNTING THE FAITH was a difficult horse to drive and in retrospect he should not have engaged Ms Compain for the drive.

In fixing penalty the committee took into account the following matters;-

1. The guilty plea

  5. Ms Compain's relatively good driving record
  6. --
  7. The offending was at the middle to lower end of the scale

Balancing those matters, Ms Compain's horsewoman's licence was suspended for two days commencing at the conclusion of racing on 13th October 2006 and ending at the conclusion of racing on 20th October 2006.
