An information was lodged following race eight alleging a breach of Rule 869 (3) (b) "Careless Driving ".
--The information alleged that horseman Mr. D. Balle drove Cowdrey carelessly when impro ving his horse inward cramping Chapel Maree (Mr. A Pyers), and Hanover Ace ( Mr. T Mitchell) which broke racing into the first bend. Mr Balle admitted the breach of this rule and was present at the hearing .
--Mr Muirhead showed the video of this incident and this clearly showed Hanover Ace in a break and Chaple Maree being tightened for room racing into the first bend.
--Mr Balle was observed to have pulled off however it was too late to prevent this tightening.
--Cowdrey was observed to pace roughly for a stride or two when Mr Balle tried to pull out.
--Mr Muirhead made submissions on penalty and produced the driving record of Mr Balle .
--Mr Muirhead advised that Mr Balle has a very good record and has had no charges against him for any breaches of the rules.
--Mr Muirhead sought a two day suspension of Mr Balle's horseman's licence , Mr Balle also made submissions on penalty.
--Decision and Reasons.
--Having taken into consideration the admission of the breach by Mr. Balle and also his very good driving record this Judicial Panel orders that the horseman's licence of Mr. Balle, be suspended for a period of two days up to and including the 22nd March 2007.
