An information instigating a protest lodged by Stipendiary Steward Mr J Muirhead against WHATAWEE BABE, placed 3rd by the Judge, on the grounds that it broke from its gait free of interference about 50m from the finishing line and regained its gait about a stride from the finishing line and thereby had failed to promptly regain its gait and also had failed to lose ground as a result of breaking from its gait.
--Mr I Brownlee, trainer/driver represented the connections of the horse. He contested the protest.
--Mr Muirhead showed the video film of the relevant part of the race. WHATAWEE BABE broke free of interference at about the 50m mark and lunged forward gaining about a neck on CANTINA, driven by Mr T Macfarlane, placed 4th by the Judge, and did not lose ground relative to that horse until one or two strides from the finishing line. Mr Muirhead's case was that WHATAWEE BABE initially gained ground as a result of the break and maintained that advantage for too long and that the horse had galloped too far - just under or just over 50 m, he couldn't be sure. Mr Brownlee disagreed with what Mr Muirhead had to say. He said the horse got down quick, other horses had not been disadvantaged and that his horse had lost about a length and a half as a result of breaking.
--DECISION
--In coming to my decision I took into account the following :

- Initially when WHATAWEE BABE broke it gained at least a neck advantage relative to CANTINA. --
- That advantage was maintained for most of the time that WHATAWEE BABE was not in its correct gait. --
- The Breaking Horse Regulation permits a protest to be lodged if a horse continues in a break for less than 50m in the last 200m of the race. --
- WHATAWEE BABE continued in a break for approximately 50 metres at the pressure part of the race. --
- The margin between WHATAWEE BABE and CANTINA at the finishing line was a head.
The evidence satisfied me in the particular circumstances as described that WHATAWEE BABE failed to promptly regain its gait and that it failed to lose ground as a result of the break and as a result of those matters gained an advantage over CANTINA. Taking into account the margin between the horses at the finishing line, a head, I decided the advantage gained was such that it was appropriate to relegate WHATAWEE BABE to immediately behind CANTINA and I did so.
