Decision:

As Miss Morris had admitted this breach of the Rules it was found to be proved.

Penalty:

We therefore determined that Miss Morris’ jockey's licence be suspended from the conclusion of racing on 15 January 2014 until the conclusion of racing on 23 January 2014 which encompasses the days racing at Gore 18 January, Wellington 20 January and Gore 23 January 2014.

Facts:

Following the running of Race 9, the Greenfield Motors Foton Ute Rating 65, an Information was filed by Stipendiary Steward, Mr M Zarb, against Class A Rider, Miss J Morris, the rider of MARY BURKE, alleging careless riding near the 800m, in that Miss Morris allowed her mount to shift inwards when insufficiently clear crowding DELIRIUM onto PRETTY TO WATCH which was checked.

Rule 638(1)(d) reads as follows:

“(1) A Rider shall not ride a horse in a manner which the Judicial Committee considers to be:

(d) careless”

Miss Morris had indicated on the Information that this breach of the Rules was admitted and she confirmed this at the hearing. Miss Morris also agreed that she understood the charge and the Rule it was brought under.

Mr Zarb gave evidence and used video coverage with the assistance of Senior Stipendiary Steward, Mr J Oatham to show that near the 800m, MARY BURKE, ridden by Miss Morris, was racing in a 3 wide position with DELIRIUM, ridden by Miss C Barnes, in a 2 wide position and PRETTY TO WATCH, ridden by Miss R Black on the rail. Mr Oatham gave evidence that approaching the bend near the 800 metres, Miss Morris allowed her mount to roll in forcing DELIRIUM inwards, which in turn crowded PRETTY TO WATCH, which had to check. Mr Oatham submitted that Miss Morris had shifted in approximately ½ a horse width on the bend and had made some effort, albeit too late, to keep her horse on a true line. He said that DELIRIUM was racing ¾ of a length behind MARY BURKE with PRETTY TO WATCH on that horse’s quarter. Mr Oatham also submitted that DELIRIUM and PRETTY TO WATCH were both racing in tight quarters and it did not take much movement by MARY BURKE to tighten both runners.

Miss Morris stated that she was aware of both runners on her inner and conceded that she had moved inwards but not as much as ½ a horse width. She said that DELIRIUM was racing ungenerously and Miss Barnes was having trouble holding the horse. She submitted that DELIRIUM had contributed to the tightening and resultant check to PRETTY TO WATCH.

Mr Zarb conceded that DELIRIUM was racing ungenerously to the inside of MARY BURKE and the movement by MARY BURKE was minimal but the degree of interference to PRETTY TO WATCH was severe, causing the horse to lose a couple of lengths.

Submissions for Penalty:

Mr Zarb submitted that Miss Morris had admitted the charge and that the degree of interference was mid-range with the degree of carelessness at the lower end. In regards to record, Mr Zarb stated that in the previous 12 months Miss Morris had received a 4-day suspension for careless riding at Ashburton on 13 September 2013. Mr Zarb submitted that Miss Morris had ridden on approximately 90 occasions since her last suspension and asked the Committee to consider a 3 day suspension as penalty.

Miss Morris stated that prior to her latest suspension she had not been suspended for 3 years. She also submitted that a 2-day suspension would be an appropriate penalty. Miss Morris also submitted that she had ridden on occasion in the Central Districts over the past 6-8 weeks and stated that she was intending to ride at the Wellington meeting on 20 January 2014 and had someone organising rides for her. Miss Morris also stated that she had engagements for the upcoming meeting at Hokitika on 15 January 2014 for which the fields were already drawn.

Mr Zarb submitted that the Stewards would not consider the meeting at Wellington to be relevant in regard to any suspension as Miss Morris was predominantly a South Island rider. However, the Committee accepted Miss Morris’ submission that she would be riding at that Wellington meeting.

Reasons for Penalty:

In determining penalty the Committee took into consideration Miss Morris’ previous breach in September 2013 and her good record prior to this recent suspension. We also took into consideration that Miss Morris was a predominantly South Island rider, the breach was admitted and that the level of carelessness was low with the level of interference at mid-range. Taking the JCA Penalty Guide recommended starting point of 5 days we were able to give a discount of 1 day for the fact that Miss Morris is predominantly a South Island rider in conjunction with her good record. We were also able to give a further discount of 1 day for her admission of the breach and that the breach was at the low to mid end of offending. We therefore determined that a 3-day suspension was an appropriate penalty.

The Committee also granted a deferment of penalty for 4 days with the suspension beginning after racing on 15 January 2014.
