Facts:
Following the running of race 6, Information A5901 was filed by Stipendiary Steward Mr C Allison under Rule 869(2)(a). The information stated “R Close used his whip excessively when driving out MOTU HAUGHTY HELEN in the home straight”.
Mr Allison advised that when Mr Close had initially been shown the film of his use of the whip in the home straight he was assisted by Open Horseman Mr P Fleming. After viewing the film Mr Close signed the information admitting the breach. Mr Allison also advised that Mr Close had indicated he did not wish to be present at the hearing and the Chairman endorsed the Information to that effect.
Rule 869(2)(a) states:- “No horseman shall during any race use his whip in an unnecessary, excessive or improper manner”
Submissions for Decision:
Mr Allison used the head-on film to identify Mr Close leading the field at the top of the home straight. He said Mr Close used his whip approximately 25 times including 2 “backhanders” as he drove his horse to the line to win the race. He also showed the side on film but because Mr Close is left handed many of the strikes could not be clearly seen although the 2 “backhanders” could be.
Submissions for Penalty:
Mr Allison said Mr Close had not breached this Rule in the previous 12 months, was a junior driver and had readily admitted the breach which the Stewards categorised the seriousness of as being in the low/mid range. He submitted a fine of similar to those given to 3 drivers who breached the same Rule on the first day of the meeting was an appropriate penalty.
Reasons for Penalty:
The Committee has reviewed the films of the incident and notes that Mr Close did use his whip on approximately 25 occasions in the home straight. Whilst many of the strikes were not overly forceful 25 strikes is too many. The Committee notes this is Mr Close’s first breach of the Rule for more than 12 months and that he admitted the breach at the earliest opportunity. The Committee is also aware of the penalties given to 3 drivers for similar breaches of the Rule on the first day of the meeting and has also reviewed recent penalties for similar breaches of this Rule and believes on this occasion a fine is an appropriate penalty.
