Mr Ferguson had directed his horse inwards across the line of ITALIAN LASS causing that horse to break and lose all chance.

On the issue of penalty Mr Escott noted that although the interference caused ITALIAN LASS was significant a fine was appropriate given Mr Ferguson’s commitments and obligations to owners in the near future.

Mr Ferguson stated that there was no contact between the horses and referred to his ready admission of the charge.

The carelessness on this occasion is of an order which would normally warrant a suspension. However Mr Ferguson will be spared that because of his candid acknowledgement of culpability and Mr Escott’s mitigating comments. He is fined $500.
