Mr Jones indicated the breach of the rule was admitted and also that he did not wish to be present at the hearing of the information. As the breach of the rule was admitted the charge was found to be proved.
Penalty:
The Committee has taken into consideration the aggravating and mitigating circumstances outlined above and also recent penalties for similar breaches of the rule and has decided a fine is an appropriate penalty. Mr Jones is fined $200.
Charge:
Following the running of race 4, information 69452 was filed by Stipendiary Steward Mr T Taumanu under rule 869 (2) (a). The information stated that “D Jones (Schnapper Smile) used his whip excessively in the run home”.
Rule 869 (2) (a) states “No horseman shall during any race (a) use his whip in an unnecessary, excessive or improper manner”.
Facts:
Mr Taumanu used the side-on view of the film to identify Mr Jones and to show what had occurred. He said that as the horses were entering the home straight Mr Jones, who was running second had struck his horse 22 times with the whip. The film showed there was a short break after the first 3 strikes and Mr Taumanu said that a couple of the strikes had hit the dust sheet. He said, however, 22 strikes over the space of 300m was excessive and not a good look to members of the public watching the race on course or on TV.
Submissions for Penalty:
Mr Taumanu said this was Mr Jones first offence under this rule and submitted that a fine of $200 would be an appropriate penalty.

The Committee has reviewed the film of the incident referred to and listened to the submission made. The Committee has noted Mr Jones struck his horse 22 times in the final 300m of the race and believes this use of the whip was excessive and a breach of the “use of whip” guidelines.
