Decision:

The committee determined that Mr B Butcher should drive Get Holme Tyron and that Mr S Lawson should drive Iwannabebig.

Facts:

Mr Z Butcher requested a ruling from the committee that Mr B Butcher should drive Get Holme Tyron and that Mr S Lawson should drive Iwannabebig. The official race book showed Mr S Lawson as being the driver of Get Holme Tyron and Mr M McKendry as the driver of Iwannabebig.

Submissions for Decision:

The committee heard from Mr Z Butcher, Mr T Fox, Mr Hobbs and Mr Muirhead. Mr Muirhead outlined the reasons for the request for a ruling and said that under the Harness Rules of Racing it is the responsibility of trainers to declare drivers. He added that for some reason in the central districts a good number of drivers actually declare their drives to the secretary.

Mr Hobbs said that this does occur from time to time as it is more convenient with a lot of the trainers not being in attendance at central districts meetings and with the tight time frame he works within this assists to have the race books printed for the second day of meetings. On this occasion as he had not heard from the trainers concerned or the drivers he thought he was doing the right thing in nominating the drivers that were shown in the race book. His reasoning was that S Lawson drove Get Holme Tyron on the first day and that Mr McKendry was available to drive Iwannabebig.

Mr Z Butcher said that they (the Butcher horsemen) whenever possible drive the Scaife horses and that Mr B Butcher should be driving Get Holme Tyron.

Mr Fox said that whilst he would be happy with Mr McKendry driving his horse his preference was for Mr Lawson as he had previously driven the horse.

Mr Scaife confirmed that the Butchers do drive his horses whenever possible and said that he believed that Mr Butcher was driving his horse on this occasion.

Reasons for Decision:

The committee was satisfied that with the short time frame to have the race books printed, and have the drivers notified, plus due to a lack of communication, Mr Hobbs had made a genuine mistake in nominating Mr Lawson for Get Holme Tyron and Mr McKendry for Iwannabebig. The committee did not have any criticism of Mr Hobbs as he believed he was acting in the best interests of all concerned. The committee was satisfied that the Butcher horsemen did have first call on the P Scaife horses, and took into account that Mr Lawson had driven Iwannabebig on the first day of the meeting.
