Following the running of race 9 information number A2390 was filed with the judicial committee by Stipendiary Steward Mr J Muirhead under rule 869 (2) (a). The information stated that Mr Clarke used his whip excessively when driving Tinted Field over the concluding stages.
The committee was advised that Mr Clarke did not wish to be present at the hearing.
Facts:
Mr Muirhead played the films to identify Mr Clarke and to show what had occurred. He said that in the run down the final straight Mr Clarke had hit his horse 22 times and that the action of Mr Clarke looked bad.
Submissions for Penalty:
Mr Muirhead said that Mr Clarke had a good record and that penalties imposed for similar breaches had been met with fines of between $200 and $300. He asked the committee to take into account that it was a lower grade race and that Mr Clarke has had 11 drives this season and had 37 drives last season.
Reasons for Penalty:
The committee gave due consideration to all matters put to it by Mr Muirhead and believed a fine of $200 was an appropriate penalty.
