As Mr Dickie admitted the breach it was found to be proved.

Charge:

Following the running of race 9 information number A2389 was filed with the judicial committee by Stipendiary Steward, Mr J Muirhead under rule 869 (2) (a). The information stated that junior horseman Mr J Dickie used his whip excessively when driving Guilty Verdict over the concluding stages.

Mr Dickie acknowledged that he understood the rule and the charge.

Facts:

Mr Muirhead played the films to show what had occurred. Mr Muirhead identified Mr Dickie and his drive and said that in the run down the home straight Mr Dickie had struck his horse with the whip approximately 26 times.

Mr Dickie who finished 5th said that it was a close finish and that he was really only flicking his horse.

Mr D Butcher who assisted Mr Dickie at the hearing said that whilst Mr Dickie did hit his horse several times it wasn’t a bruising drive and that the last few strikes were on the crupper.

Submissions for Penalty:

Mr Muirhead said that Mr Dickie had a clean record over the last 12 months, that he had admitted the breach, and that it was a lower class race. He said that similar breaches had been met with fines of between $200 and $300.

Mr Dickie said that the strikes were only flicks and asked that a minor fine be imposed.

Mr Butcher said that as it wasn’t a bruising drive a fine of $150 would be adequate.

Reasons for Penalty:

The committee after careful consideration of all the matters relative to the charge including the starting point of $300 reached the conclusion that a fine of $200 was an appropriate penalty.
