Following the running of Race 5, The Ultimate Venue Mobile Pace, an information was filed by Stipendiary Steward Mr T. W. Taumanu against Mr C. R. Driver, the driver of "Presidell" (6), alleging that he had committed a breach of Rule 869(2)(a) in that he had used his whip in an unnecessary manner on a beaten runner.

Following the running of Race 5, The Ultimate Venue Mobile Pace, an information was filed by Stipendiary Steward Mr T. W. Taumanu against Mr C. R. Driver, the driver of "Presidell" (6), alleging that he had committed a breach of Rule 869(2)(a) in that he had used his whip in an unnecessary manner on a beaten runner.

Mr Driver is a Junior Horseman, but advised that he did not wish to have the assistance of a senior horseman. Mr Driver had indicated on the information that he admitted this breach of the Rules, and he confirmed this at the hearing. He also agreed that he understood the charge and the Rule it was laid under.

Stipendiary Steward Mr Renault used video coverage to show this incident, which related to Mr Driver using his whip on a number of occasions in the run home. Although Mr Driver’s horse was in or near the lead on entering the home straight, it quickly dropped out of contention, but Mr Driver continued to use his whip on an obviously beaten runner. Mr Driver conceded that what he had done was wrong.

Penalty:

Mr Taumanu advised that Mr Driver had no previous relevant convictions. The choice of a fine or a suspension was raised with Mr Driver, and he said that he preferred a fine. A fine of $250-00 was recommended, and Mr Driver had no relevant submissions to make relating to penalty.

We adjourned to consider the matter of penalty. We were satisfied that a fine of $250-00 was appropriate in this case and on returning to the Enquiry Room we advised the parties that Mr Driver would be fined the sum of $250-00.
