DECISION AND REASONS:
--Following the running of Race 11 an information was laid by Chief Stipendiary Steward Mr N. R. Escott, against Mr D. J. Butt the driver of "OK Jaque" (4) alleging that Mr Butt had committed a breach of Rule 869(4) in that with approximately 50 metres to run he had allowed his horse to shift inwards and lock wheels with "Coppertone".
------Mr Butt had indicated on the information that he admitted this breach of
--the Rules, and he confirmed this plea at the hearing. Mr Butt also agreed that the evidence from the protest hearing should form the basis for this hearing.
--PENALTY: Mr Escott advised that Mr Butt had no previous relevant convictions, and recommended a fine of $250-00. It was Mr Butt's view that this fine was too high and that he had already been penalised by the relegation of his horse.
--We adjourned for a short time to have a look at previous penalties for similar offences. Having satisfied ourselves that the fine recommended was in line with previous penalties we returned to the Enquiry Room and advised Mr Butt that he would be fined the sum of $250-00.
