DECISION AND REASONS:
--Following the running of Race 2, New Commercial Hotel Trot, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, against MONARO MISS (C D Thornley), placed 3rd by the judge, on the ground of breaking from its gait with 2000 metres to run.
----Mr C D Thornley represented the connections of MONARO MISS at the hearing of the information.
----Mr B D Williams, Assistant Stipendiary Steward, showed video replays of the relevant part of the race. He pointed out MONARO MISS leading coming around the highway bend (the bend into the back straight). The horse shied and broke and galloped for "some considerable distance" along the back straight, despite Mr Thornley's efforts to return it to its proper gait. Mr Williams estimated that MONARO MISS had galloped for approximately 200 metres.
----Mr Escott sought disqualification of MONARO MISS.
----Mr Thornley accepted that the horse had breached the Breaking Horses Regulation in that it had galloped for a distance in excess of 150 metres.
----The Committee was satisfied, on the basis of the evidence of Mr Williams (including the video evidence) and Mr Thornley's acknowledgement that MONARO MISS had galloped for a distance in excess of 150 metres, that MONARO MISS had broken from its gait with approximately 2000 metres to run in the race and had continued on in a break for a distance of 150 metres or greater and was, therefore, in breach of Rule 870 (3) in that it had failed to promptly regain its proper gait. In terms of the Breaking Horses Regulation, the Committee was required to either relegate or disqualify MONARO MISS.
----In this instance, the appropriate course of action was to disqualify MONARO MISS and, accordingly, the Committee upheld the protest and ordered that MONARO MISS be disqualified from the race.
----Consequent upon the disqualification, the amended placings for the race are as follows:
----1st 13 Starwood in Aspen
--2nd 5 Love Hate Revenge
--3rd 9 Good Charlotte
--4th 11 Mentor
--5th 12 Shezadorabil.
