Following the running of Race 4, a protest was lodged by the Stipendiary Stewards against horse no. 1, Worth Plenty (S Walkinshaw), placed 3rd by the Judge



Following the running of Race 4, a protest was lodged by the Stipendiary Stewards against horse no. 1, Worth Plenty (S Walkinshaw), placed 3rd by the Judge, on the grounds of breaking within the final 50metres, and being lapped on to horse no. 9, Roydon Quest.

The placings were: 1st - No 11, 2nd - 4, 3rd - 1, 4th - 9, 5th - 3, 6th - 10.

In this case, Mr Walkinshaw, representing the connections of Worth Plenty, did not contest the protest, attesting to such by endorsing the Information. To the chairman he indicated he understood the rule and he accepted that his horse, Worth Plenty, was in a break and lapped on at the finish of the race.

Presenting the circumstances, stipendiary steward, Mr McIntyre, referred to the video of the race which showed that Worth Plenty (S Walkinshaw) broke inside the final 50metres. He said it was clear that Mr Walkinshaw has taken immediate action but the horse was still in a break at the finish and was lapped on by the 4th horse (Roydon Quest).

In summation, this protest under Rule 870(5) was brought by the Stipendiary Stewards following Race 4 against horse no.1, placed 5th by the Judge, that horse being Worth Plenty.

The purpose of the enquiry is to establish if the horse was in a break and lapped on (to Roydon Quest) as alleged by the stipendiary stewards and I am satisfied, after hearing the circumstances and viewing the film, that it was and (as indicated earlier) this has not been contested by driver, Mr Walkinshaw, who was representing the connections.

In this case, there is no discretion where the horse breaks free of interference and is lapped on. I find that Worth Plenty has broken and is still in a break and lapped on to the 4th horse (Roydon Quest) at the finish of the race, and is therefore in breach of Rule 870(5).

The protest is upheld and horse no.1, Worth Plenty, initially placed 3rd by the Judge, is relegated behind Roydon Quest, which had been placed 4th by the Judge. The placings will now read:-
