Following the running of race two on the programme, an Information was lodged against driver Ms A Tomlinson, alleging a breach of Rule 869(2)(a), in that she used her whip excessively

Following the running of race two on the programme, an Information was lodged against driver Ms A Tomlinson, alleging a breach of Rule 869(2)(a), in that she used her whip excessively in the run home when driving Zsa Zsa. Ms Tomlinson admitted the breach.

Presenting his case, stipendiary steward, Mr Ydgren, referred to the video of the race, which showed Ms Tomlinson in the trail and striking Zsa Zsa 20 times in the run home without any pause or break in the use of the whip and, in the view of the stipendiary stewards, such use was excessive.

Regarding penalty, Mr Ydgren said that Ms Tomlinson had a clean record and, as a first offence, he recommended a moderate fine in keeping with such breaches.

In her submissions, Ms Tomlinson said she had a problem with her whip action which she is trying to correct and for which she is taking advice. However, she subscribed to the theory that ?if it looks bad, it is bad? and she agreed it looked bad on this occasion. She had no submissions to make on penalty.

In this case, Ms Tomlinson appears on a charge under Rule 869(2)(a) following the running of race two, in that she used her whip excessively on Zsa Zsa, specifically in the run home.

I accept the recommendations of the stipendiary steward, and note that Ms Tomlinson is taking corrective action. She is to be given some credit for that and for her driving record. For this first offence, I am satisfied that a moderate fine is appropriate, and a fine of $200.00 will apply.
