Decision:

Following the running of Race 3, More FM Marlborough Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Open Horseman, Mr S J Thompson, alleging that Mr Thompson “used his whip excessively in the run home whilst driving MEVAGISSEY MICKEY”.



Following the running of Race 3, More FM Marlborough Mobile Pace, an information was filed by Stipendiary Steward, Mr N M Ydgren, against Licensed Open Horseman, Mr S J Thompson, alleging that Mr Thompson “used his whip excessively in the run home whilst driving MEVAGISSEY MICKEY”.

Mr Thompson was present at the hearing of the information and admitted the breach.

Mr Ydgren showed a video replay of the final stages of the Race. Mr Ydgren said that it was alleged by the Stipendiary Stewards that Mr Thompson had used his whip approximately 22 times with no respite. It was no excuse that Mr Thompson’s horse had been involved in a close finish. Mr Thompson is an experienced driver and well aware of the guidelines regarding use of the whip, Mr Ydgren said.

Mr Thompson acknowledged to the Committee that he was aware of the guidelines. He stated that many of the hits were on the sulky shaft. There was no “malice” or wish to harm the horse – he just wished to make the noise of the whip on the shaft.

Mr Ydgren informed the Committee that Mr Thompson, who is in his first year as a senior horseman, had been fined $200 for excessive use of the whip on 20 June 2008. He sought a fine of $300 or a suspension of 2 days. Mr Ydgren also referred to Mr Thompson’s “open and frank admission” of the breach.

The Committee, in arriving at penalty, took into account Mr Thompson’s admission of the breach and the previous breach of the same Rule in June 2008.

Mr Thompson was fined the sum of $250.
