Following the running of Race 2, Auto & Marine Services Kaikoura Trot, an information instigating a protest was filed by Stipendiary Steward, Mr N G McIntyre, against CRUSADER CROWN (I R Cameron), placed 3rd by the judge, on the grounds of interference to BRITE AUTUMN (D J Dunn), placed 4th by the judge, after approximately 200 metres.



Following the running of Race 2, Auto & Marine Services Kaikoura Trot, an information instigating a protest was filed by Stipendiary Steward, Mr N G McIntyre, against CRUSADER CROWN (I R Cameron), placed 3rd by the judge, on the grounds of interference to BRITE AUTUMN (D J Dunn), placed 4th by the judge, after approximately 200 metres.

Mr I R Cameron, part-owner, trainer and driver of CRUSADER CROWN was present at the hearing of the information representing the connections of that horse.

Mr Dunn said that his horse had made a good beginning and was racing towards the outside of the track. Mr Cameron’s horse galloped in front of him and came out. Mr Dunn said that he had to “correct” his horse as a result of which it galloped.

Mr N M Ydgren, Stipendiary Steward, showed video replays of the incident. He pointed out the two horses concerned. He pointed out CRUSADER CROWN break and come out and continue to come out. He alleged that Mr Dunn had to shift ground and his horse went into a break.

Mr Cameron stated that his horse had galloped and moved out but, he said, he had straightened before Mr Dunn got up to his wheel. There was no contact and there was always a gap between the two horses. He had looked round, had seen Mr Dunn coming and had straightened his horse to give Mr Dunn room on his outside. BRITE AUTUMN broke before it got up to his wheel, Mr Cameron said. He had not crossed Mr Dunn who was always on his outside.

Mr Dunn acknowledged that he only had to “angle slightly” and did not receive a “severe check”.

The Committee had viewed the video replays carefully and had listened to the evidence of the parties. In terms of Rule 869 (8), the Committee needed to be satisfied that CRUSADER CROWN may have interfered with the progress or chance of BRITE AUTUMN when it broke after approximately 200 metres in the Race. The Committee accepted the evidence of Mr Cameron, which was supported by the video evidence, that there was at all times room on the outside for Mr Dunn’s horse and that at all times there was a gap between the two horses. The Committee was not satisfied that Mr Dunn’s horse broke, when it did, as a result of having received interference from CRUSADER CROWN. The Committee was not satisfied that interference had taken place. Furthermore, Mr Dunn’s evidence was equivocal at best.

The protest was dismissed and the judge’s placings for the Race stand.
