Following the running of Race 7, Alabar Kaikoura Cup, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, by AWESOME ARMBRO (D J Butcher), placed 5th by the judge, against FAKE CHANCE (R A Sharpe), placed 2nd by the judge, on the grounds of interference with approximately 150 metres to run.

DECISION AND REASONS:
--Following the running of Race 7, Alabar Kaikoura Cup, an information instigating a protest was filed by Chief Stipendiary Steward, Mr N R Escott, by AWESOME ARMBRO (D J Butcher), placed 5th by the judge, against FAKE CHANCE (R A Sharpe), placed 2nd by the judge, on the grounds of interference with approximately 150 metres to run.
----Mr Sharpe informed the Committee that he was authorised to represent the connections of FAKE CHANCE at the hearing of the information.
----The official margins in the race were 2 lengths, a head and 1 length. AWESOME ARMBRO finished in 5th placing a further 1.4 lengths back.
----Mr Escott called Mr Butcher to give evidence. Mr Butcher said that, after turning for home, Mr Sharpe had angled out to come off the back of the leader (BONDY), and the leader drifted out. He (Mr Butcher) had started to look for a run on his inside. At that stage, there was a gap on the inside of FAKE CHANCE – a good cart’s width, he said. Mr Sharpe then shifted back down. Mr Butcher called to Mr Sharpe a couple of times, got up to FAKE CHANCE’s wheel, and then had to restrain his horse. Mr Butcher was uncertain whether he had contacted any pylons but was "really close". When asked by Mr Escott if his chances were affected Mr Butcher that they "probably were". The leader had run a 55-second last 800 metres – he had lost his momentum and it was difficult to get going again, Mr Butcher said.
----Video replays of the final 200-300 metres of the race were shown to the Committee. Turning into the home straight, BONDY (D J Butt) was in the lead with CLASSIC CULLEN outside it and FAKE CHANCE in the trailing position, with AWESOME ARMBRO improving behind it along the markers.
----Mr N G McIntyre, Stipendiary Steward, said that he had viewed the race from the patrol box at the entrance to the home straight. He said that CLASSIC CULLEN had shifted out half a cart and, approaching the 200 metres, Mr Sharpe had attempted a run, which did not eventuate, between BONDY and CLASSIC CULLEN. He had shifted back on to BONDY’s back and attempted to go inside that horse. He then noticed AWESOME ARMBRO brush a pylon and Mr Butcher had to take hold of the horse.
----Mr Sharpe submitted that both FAKE CHANCE and AWESOME ARMBRO had gone for the same gap at the same time and he had beaten AWESOME ARMBRO to the gap. He explained that the only reason that he had shifted down was that BONDY and CLASSIC CULLEN had both moved back down. He knew that AWESOME ARMBRO was behind him but he was not aware it was making any ground. He felt that he had a right to the gap. There were no horses either side of him. Mr Sharpe stated that he believed he had "clear room" to take the gap and was clear of AWESOME ARMBRO. There was no contact with AWESOME ARMBRO, he said. The tightening was caused by the two leaders shifting ground. Mr Sharpe referred to the margins at the finish.
----The Committee was satisfied that any interference that took place was minimal and Mr Butcher’s having to take hold of AWESOME ARMBRO was principally the result of his being beaten to the inside gap by FAKE CHANCE. The Committee found that Mr Sharpe was entitled to take the gap and did so safely, beating Mr Butcher to that gap. In any event, the Committee was not satisfied that the chances or progress of AWESOME ARMBRO were affected. It appeared to the Committee, from its viewing of the video replays and from Mr Sharpe’s evidence, that AWESOME ARMBRO was unlikely to have finished in a higher placing even if it did not have to be eased by Mr Butcher some 100-150 metres from the finish. The Committee noted the official margins and, in particular, the margin between 4th and 5th of 1.4 lengths.
----Accordingly, the protest was dismissed and the judge’s placings for the Race stand.
