Following the running of Race 3, More FM Marlborough Mobile Pace, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Open Horseman, Mr L C May, alleging a breach of Rule 869 (2) (a) in that Mr May “used his whip excessively in the run home when driving DREAMER”.
 



Following the running of Race 3, More FM Marlborough Mobile Pace, an information was filed by Chief Stipendiary Steward, Mr N R Escott, against Licensed Open Horseman, Mr L C May, alleging a breach of Rule 869 (2) (a) in that Mr May “used his whip excessively in the run home when driving DREAMER”.
 
Mr May had signed the Statement by the Defendant on the information form indicating, firstly, that he admitted the breach and, secondly that he did not wish to be present at the hearing of the information. The breach was found proved accordingly.

Rule 869 provides as follows:
(2)  No horseman shall during any race:-
     (a)   use his whip in an unnecessary, excessive or improper manner.

Mr N M Ydgren, Stipendiary Steward, showed a video replay of the final 300 metres or so of the Race. He pointed out Mr May, driving DREAMER, challenging wide on the track. From the point at which he turned his whip round, Mr May used his whip on 22-23 occasions. DREAMER finished in 4th placing.

Mr Escott informed the Committee that Mr May had a clear record. He recommended a fine of $200.

--

Taking into account Mr May’s admission of the breach and his previous good record, the Committee fined Mr May the sum of $200.
