Decision: --

Stipendiary Steward Mr Knowles alleged that LANGHAM GOLD, driven by G Thomas, moved inside the marker pegs for approximately 40 metres inside the final 600 metres.  Rule 869(7)(b) is a very explicit rule. It says "where a horse or its sulky wheel moves inside the track marker line for more than 30 metres in the last 600 metres of a race the horse shall be disqualified from that race except where it is established that the breach was caused by interference by another horse or horseman".

--

Video evidence was shown from four different cameras. It failed to clearly show whether LANGHAM GOLD went inside more than three pegs. All agreed three pegs but it appeared that the horse struck directly on the fourth peg and the fifth peg. The pegs are approximately 10 metres apart.

--

Mr Lock, Trainer of LANGHAM GOLD and Horseman Mr Thomas said the horse was a recent gain for the stable and this was his second start for Mr Lock. At his first start at Roxburgh he had not been on the inside running at any stage. They are working on gear changes.

--

Taking into account that it was unclear whether more than three pegs had been passed on the inside, I dismiss the Protest but remind Mr Lock that the horse will need to improve his performances in the future.
