We therefore find the breach proved.

Penalty:

We impose a fine of $200.

Facts:

Following the running of Race 6 the bMAC SHEETMETAL MOBILE PACE, an information was filed by Stipendiary Steward, Mr Munro, alleging that Mr Williamson, the driver of CHILLI FRANCO, used his whip on more occasions than is permitted in clause (b) of the use of the whip regulations.

Rule 869 provides as follows:

(2) No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.

The Use of the Whip Regulations provide:

(b) No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.

Mr Munro, Stipendiary Steward, demonstrated on the race films that the respondent used his whip 12 times from the top of the bend and in the home straight. This was inclusive of 7 freehand strikes and 5 “backhanders”. CHILLI FRANCO, which had improved around the field 3 wide, finished in 3rd place.

Mr Williamson admitted the breach and indicated on the information that he did not wish to be present at the hearing.

Submissions for Penalty:

Mr Munro said Mr Williamson was a very busy driver. He had had 427 drives last season and 407 this season prior to today. He submitted the starting point in the JCA penalty guidelines was a fine of $200. He believed this was the appropriate penalty, as despite Mr Williamson having a previous breach on 27 January last, this was his 201st drive since that time. The reset period thus applied.

Reasons for Penalty:

The Committee is satisfied that Mr Williamson used his whip 12 times inside the final 400 metres. The breach is thus within the low range, which is 11 to 13 strikes. Mr Williamson’s record has reset after 200 drives. He is very fortunate as this is his 1st drive in the new period.
