We therefore find the breach proved.

Penalty:

Having regard to these matters, we impose a fine of $200.

Facts:

Following the running of Race 2 the PLEASE SHUDDUP ONLY $80 A MONTH MOBILE PACE, an information was filed by Stipendiary Steward, Mr Renault, alleging that Mr Walkinshaw, the driver of DOUBT ME NOT, used his whip on more occasions than is permitted in clause (b) of the use of the whip regulations.

Rule 869 provides as follows:

(2) No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.

The Use of the Whip Regulations provide:

(b) No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.

Mr Renault demonstrated on the race films that the respondent used his whip 12 times in the home straight. DOUBT ME NOT finished in 2nd place.

Mr Walkinshaw admitted the breach and indicated on the information that he did not wish to be present at the hearing.

Submissions for Penalty:

Mr Renault said Mr Walkinshaw was a busy driver considering that he had had a time away from race driving due to injury. He had had 189 drives last season and 130 this season prior to today. The starting point in the JCA penalty guidelines was a fine of $200. He submitted that this was the appropriate penalty.

Reasons for Penalty:

The Committee is satisfied that Mr Walkinshaw used his whip 12 times inside the final 400 metres. The breach is thus within the low range, which is 11 to 13 strikes. Mr Walkinshaw’s record is clear under this rule for the past 12 months, with his previous breach being at the final meeting for the season a year ago.
