Mr Beck admitted the breach and it is found proved.

Mr Beck is suspended from the end of racing today, 8th December, up to and including the 22nd December 2018 (3 days).

Facts:

Mr A Beck was charged with a breach of r869 (2) excessive use of the whip, following his drive on MAAHES in race 2 the Matt “The Battler” Saunders Mobile Pace. Stewards alleged Mr Beck “used his whip on more occasions than permitted under clause (b) of the Use of the Whip Regulations.”

Rule 869 (2) reads: No horseman shall during any race:

(a)    use his whip in an unnecessary, excessive or improper manner.

The Whip Guidelines read:

(b)    No horseman is permitted to use their whip in a striking motion on more than 10 occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.

Mr Beck admitted the breach and appeared at the hearing.

Mr McIntyre, with the aid of the video replays pointed out the relevant position of MAAHES from about the 400m mark.  He said Mr Beck was seen to use his whip 12 times inside the final 400m. He said the first 10 strikes were with rein and hand with the last two, back-handers, inside the final 50m.

Mr Beck stated his horse felt lethargic and he was trying to maintain his trailing position. He did not believe that he was making contact with the horse when using the whip and rein hand together.

Submissions for Penalty:

Mr Munro stated Mr Beck had a previous breach of the rule in late September. This was his second offence inside the six month period. The Penalty Guide for a second offence was a three day suspension. Mr Beck had admitted the breach and the number of strikes was at the lower end.

Mr Beck made no submission as to penalty.

Reasons for Penalty:

Mr Beck admitted the breach and his whip use was at the lower end of the scale. The penalty for a second breach of the rule inside six months is a three day suspension and we found no reason to depart from that.
