Facts:
Following the running of Race # 7 the Facebook.com/Southern Harness Racing Mobile Trot, Licensed Horseman Mr A Beck (Mum Beat Lyall) lodged an information alleging the 3rd placed horse Snow Boy (Mr R McIlwrick) caused interference to his horse shortly after the start. The Information alleged Snow Boy (3) hung inwards checking Sunshine Whiz (10) which in turn checked Mum Beat Lyall when approaching the first bend.
The Protest was lodged under Rule 869 (A) (2).
Rule 869 (A) (2) reads:
When a placed horse or its driver causes interference to another placed horse and the Judicial Committee is satisfied that the horse interfered with would have finished ahead of the that horse, that or whose driver, caused the interference the Judicial Committee must, in addition, to any other penalty that may have been imposed, place the horse that, or whose driver, caused the interference immediately after the horse interfered with.

Mr Beck stated that approaching the first bend Snow Boy had made contact with Sun Shine Whiz causing that runner to break. He had been forced to take evasive action and in doing so his horse had gone into a break. By the time his horse recovered he estimated his horse had lost 4/5 lengths and had to settle at the rear of the field. His horse had finished on strongly over the final 400m and was 2 lengths from Snow Boy at the finish. He was of the view the early break and loss of ground had cost him a chance of finishing ahead of Snow Boy.
Mr McIlwrick (Snow Boy) stated his horse had hung inwards approaching the first bend. He was aware Sun Shine Whiz was on his inner and he had made every attempt to keep his horse clear. However, contact was made with the inside running causing it to break. He said Snow Boy had tired over the final 200m.
Mr Lock was of the view Sun Shine Whiz was trotting roughly prior to the incident and his horse was not at fault.
Reasons for Decision:
The committee, after hearing the evidence and viewing the video replays were satisfied that Snow Boy hung inwards approaching the first bend causing interference to Sun Shine Whiz, with resulting interference to Mum Beat Lyall.
Mum Beat Lyall lost approx. 5 lengths in the incident settling near the rear of the field, before running on strongly to finish in 4th place 2 lengths behind the third placed Snow Boy.
The committee is satisfied that Mum Beat Lyall’s chances of finishing ahead of Snow Boy were affected by the earlier interference. The Protest is upheld.
