Driver, Mr SG Dickson, was charged with a breach of Rule 869(6)(b) & (c).

Decision and Reason:

All parties agreed that evidence given at the previous protest was to be accepted without alteration.

--

Mr Allison once again explained (Using video footage) his interpretation and why he felt that Mr Dickson's action in moving out when he did, was in breach of rule 869 (6) (b) & (c).

--

Mr Dickson was adamant that his actions did not affect any other horse but he stated that he understood the rule that he was being charged with and agreed to disagree on the point of law.

--

The committee upheld the charge and Mr Dickson was fined the sum of $250.00.

--

REASONS: The committee were of the firm belief that Mr Dickson 's horse did clearly move out as outlined in the protest decision (Inf no. 12195).
