Facts:

One hour prior to Race 1, the Stirling Auto Repairs/ Clean-Biz Junior Drivers Trot, Mr Munro, Stipendiary Steward, requested a ruling pursuant to the Horseman’s Licences Regulations as due to weather conditions and transport difficulties, two horses in Race 1 did not have drivers. There were no other junior drivers available. The Stewards wished to upgrade two trials horsemen for this race only.

The last paragraph of the Horseman’s Licences Regulations, Junior Horseman, states:

At the declaration time for notification of drivers, if there is any horse or horses entered in a race restricted to junior horsemen for which a junior horseman cannot be engaged, the owner or trainer may with the permission of the Stipendiary Steward in charge of the meeting, engage a trials horseman to drive their horse. The Stipendiary Steward shall before granting such permission, be satisfied that no junior horseman could reasonably have been engaged.

Submissions for Decision:

Mr Munro explained that the conditions for Race 1 were that it was a Junior Drivers only race. Senior horsemen were not permitted to drive in the race. Junior drivers, Ms S Tomlinson and Mr J Morrison, were unable to attend the meeting due to travel delays as a result of Invercargill airport being closed and the flight from Christchurch not being able to land. The horses concerned were #2 SPURRED BY SUCCESS and #3 OUR FOXY LADY.

No other junior drivers were available and the alternative to scratching the two horses concerned was to permit two trials drivers to drive them in this race. He had spoken to the connections of the two horses and they preferred this latter course of action.

The two drivers concerned were Mr J Forbes and Mr T Larsen. Mr Munro recounted the experience of these two young men and stated that their employers and the RIU were of the view that they were capable of driving the particular horses in the race in question. Mr Munro emphasised that the race was a trot not a pace. Thus the speed of the race would not be as great.

Reasons for Decision:

After considering the RIU’s submissions, the views of the employers of the two trials drivers and the connections of the two horses as conveyed to the Committee by the informant, the Committee was satisfied that the two horsemen concerned had sufficient experience to be able to adequately perform their duties Race 1. In particular, that the safety of drivers and horses would not be compromised by their inclusion in the field. The Committee asked that the TAB be notified immediately of the change in drivers for SPURRED BY SUCCESS and OUR FOXY LADY.
