The committee was satisfied a clear breach of the rule had occurred. The video clips of the incident clearly show Mr Larsen’s horse XTREME LUCK coming into contact with Mr Jones horse RIVER BLACK and the tyre and tube coming adrift.

Penalty:

Mr Larsen was fined the sum of $400.00.

Facts:

At the conclusion of race 5 the Alabar Southern Supremacy Stakes Final 3YO Colts& Geldings Mobile Pace (Group 2 Race) an information (68870) was lodged by Stipendiary Steward Mr CJ Allison under rule 869(3)(b) alleging that with approximately 2,400metres to run KN Larsen (XTREME LUCK) struck the wheel of RIVER BLACK (MP Jones) causing the tyre and tube to come adrift.

Mr Larsen admitted the breach.

The rule reads No horseman shall drive carelessly.

Submissions for Decision:

Stipendiary Steward Mr CJ Allison showed the committee several video clips of the alleged incident (Front on/Back on views) highlighting in his opinion the careless aspect of Mr Larsen’s (XTREME LUCK) driving.

Mr Allison believed Mr Larsen had allowed his horse to run up onto the back of RIVER BLACK (MP Jones) without taking enough care , striking the wheel of RIVER BLACK and causing the tyre and tube to come adrift.

Mr Allison acknowledged that the horse XTREME LUCK was racing keenly however in his opinion Mr Larsen did not take enough corrective action under the circumstances.

Mr Jones (RIVER BLACK) stated that his horse was badly affected and that to finish fifth, five and a half lengths from the winner was a big effort.

Mr Larsen stated it was an unfortunate incident and that the horse was difficult to drive and had been raced very keenly.

Mr Larsen also stated that that the horse may have choked down which was confirmed by Mr Jones after the race back in the stabling area.

Submissions for Penalty:

Stipendiary Steward Mr C J Allison stated that Mr Larsen had no previous breaches under this rule in the past twelve months. Mr Allison believed the breach was mid-range in the level of carelessness. Mr Allison also stated that the race was a group two status ($40,000) and that RIVER BLACK had finished only five and a half lengths from the eventual winner.

Mr Jones asked the committee if a monetary penalty was going to be imposed could it be directed to the owners of the horse RIVER BLACK. The owners had flown him down to drive the horse and it was expensive for the horse to travel to Invercargill from Christchurch.

Reasons for Penalty:

In fixing penalty consideration was given to Mr Larsen’s early admittance of the breach, and also to his excellent driving record over the past twelve months.

The committee however was also aware of the financial status of the race and the serious effect the incident had on RIVER BLACK’s chances of finishing in a stake bearing place.

The committee also considered Mr Jones request, however on this occasion deemed it not to be an appropriate path of action due to the lack of historical information around his request.
