Facts:
Following the run of race 10 Happy 65th birthday Tom Kilkelly Fillies and Mares mobile pace an information A 1671 was filed by Stipendiary Steward Mr. S. Renault against senior horseman Mr. S. Walkinshaw alleging a breach of rule 869 (3) (B) in that he drove carelessly near the 500m when he shifted inwards and in doing so made contact with the sulky wheel of McKenzie (T. Williams) which punctured and came free of the rim.
Mr. Walkinshaw admitted the breach and was not present at the hearing.
Rule 869 (3) (B) reads as follows:
(3) No horseman in any race shall drive -
(B) Carelessly
Mr. Renault gave evidence and used video coverage with the assistance of Stipendiary Steward Mr. N. Ydgren to show (My Rona Gold) shifting ground inwards into the trailing position at the 500 metre mark when not sufficiently clear.
My Rona Gold struck the sulky wheel of McKenzie causing the tyre to puncture. Mr. Ydgren stated that there was no pressure from an outside horse when My Rona Gold moved inwards, and that an error of judgment had been made by Mr. Walkinshaw.
Submissions for Penalty:
Mr. Renault informed the committee that Mr. Walkinshaw had a clear record in regards to this rule over the previous 4 months and had driven on 217 occasions so far this season, with 305 drives last season.
He said Mr. Walkinshaw was a very busy driver, had admitted the breach at the first opportunity and that the carelessness was mid-range, and the consequences of the breach low range, in his opinion.
Mr. Renault stated that JCA Penalty Guideline starting point for a breach of this rule was a fine of $500 or 10 drive suspension. Mr. Renault submitted that a fine of $300 be considered as penalty in this case.
Reasons for Penalty:
In determining penalty, the Committee took into account Mr. Walkinshaw’s early admission of the breach, and his excellent record. We also considered this breach to be mid-range and determined that a fine was an appropriate penalty in this case.
In adopting the JCA Penalty Guide starting point of $500, we were able to give Mr. Walkinshaw a discount of $100 for his admission of the breach and a further discount of $100 for his clear record. We therefore determined that a $300 fine was an appropriate penalty in this case.
