A protest was lodged by Stipendiary Steward Mr P T Knowles, alleging that the second placed horse by the judge Tuhottutuch (A R Beck) broke free of interference with approximately 1400 metres to run, forcing the fourth horse placed by the judge, My Tan Lady (K Green) to race wider on the track losing its position.

Decision and Reason:

A protest was lodged by Stipendiary Steward Mr P T Knowles, alleging that the second placed horse by the judge Tuhottutuch (A R Beck) broke free of interference with approximately 1400 metres to run, forcing the fourth horse placed by the judge, My Tan Lady (K Green) to race wider on the track losing its position.

Mrs K Williams used several video clips of the alleged incident, highlighting in her opinion the extra ground that My Tan Lady (three wide) and Oomph (R Swain) four wide, were forced around Tuhottutouch. Mrs Williams stated that My Tan Lady was improving losing its one/one position at the time of the alleged incident.

Mr Knowles questioned Miss Green, who stated that she was inconvenienced by the breaking Tuhottutouch, clearly affecting in her opinion, the opportunity of claiming a higher dividend bearing place.

Mr Beck, admitted his horse had galloped, however, he was not of the opinion that my Tan Lady had to be restrained and subsequently forced over extra ground to more forward past his horse.

DESCISION/REASON

--

Clearly, in my opinion, from the verbal evidence of Miss Green, supported by the video clips of the alleged incident, My Tan Lady's chances were affected by having to race wider on the track, therefore affecting the opportunity to fill a dividend-bearing place.

--

The narrow margin of ? a head between the third and fourth placed horses was also a significant factor in the decision.
