For the committee to uphold a request under r 213 (1) (j) we have to be satisfied that there is something clearly amiss at the start, which affected a horse's chances. We find there is nothing that clearly indicates any interference to SPOTLIGHT THE VALLEY prior to the start.

Facts:

Following the running of race 5 the Invercargill Workouts Committee Mobile Trot Miss K Butt (SPOTLIGHT THE VALLEY) lodged a Request for a Ruling under rule 213 (1) (j) “…alleging that her horse was denied a fair start.”

Rule 213 (1) (j) reads:

A Stipendiary Steward at any time may scratch from a race or declare ineligible to start in a race until a specific condition is met any horse on all or any of the following grounds:-

(j) if a horse was denied a fair start and such occurrence materially prejudiced the chances of that horse.

In this particular incident the Stewards chose to file an Information for the Judicial Committee to determine the Ruling.

Miss Butt stated her horse was up on the gate just prior to the start. She said the horse’s nose was on the gate when she believed the gate moved in a swinging motion when the speed of the gate eased causing SPOTLIGHT THE VALLEY to break and lose its chances. She stated prior to that the horse was in a good position and trotting soundly.

Mr Ward stated there had been no mechanical problem with the mobile barrier. He said with a mobile trot start he did not pull away as quick as for pacers behind the mobile. All the front line were on the gate and he did not apply the brakes or ease the pace prior to the start.

Mr Renault stated that there was nothing visibly wrong with the pace or the mobile prior to the start.

Reasons for Decision:

The request for a ruling is dismissed and SPOTLIGHT THE VALLEY is declared an official starter.
