As Mr Hunter admitted the breach, the charge was found proved.

Penalty:

Mr Hunter was fined the sum of $300.00 and reminded of his professional obligations under this rule as this was the third breach within the last twelve months.

Charge:

Excessive use of the whip.

Facts:

Stipendiary Steward Mr Allison showed the Committee several video clips of the alleged incident highlighting Mr Hunter striking his horse Franco Ledger 22-23 times from the top of the straight to the winning post.

Mr Allison also stated that Mr Hunter did not break up his action and although it was a group race his action was above what Mr Allison thought was acceptable.

Submissions for Decision:

Mr Hunter having admitting the breach stated that several of his strikes were back handers and they would not 'turn a hair on a fly' in fact he thought that between 4-8 strikes were back handers.

Reasons for Decision:

The Committee was satisfied a clear breach of the rule had occurred as Mr Hunter had continued to strike his horse Franco Ledger for at least 22 strikes which in our opinion was excessive.

The video evidence was also conclusive.

Submissions for Penalty:

Mr Allison stated that this was the third offence of Mr Hunter's in the past twelve months under this rule.

Mr Hunter was fined $150.00 at the Gore Meeting in August and fined $350.00 at the Ashburton Meeting in November.

Mr Allison believed the breach was mid range.

Mr Hunter had no submissions on penalty.

The Committee in fixing penalty took into account that it was a group race and that some concession was given to Mr Hunter's early admittance of the breach.

The Committee was also of the opinion that at least 5 or 6 strikes were very mild back handers in the total of 22 strikes.
