Mr Robertson continued to drive the horse out when clearly it was not going to finish in a stake bearing place and was clearly struggling to make any ground from the top of the straight to the winning post.

Stipendiary Steward Mr Allison alleged that T R Robertson (Aveross Blaze) used his whip in an unnecessary manner in the home straight.
Mr T Robertson junior admitted the breach of the rule (869(2)(a).
Facts:
Mr Allison (Stipendiary Steward) showed the committee several video clips of the alleged incident highlighting Mr Robertson striking (Aveross Blaze) sixteen times from the top of the straight to the winning post.
Mr Allison stated that the horse Aveross Blaze was three wide for the last round of the race and did not make up any ground in the home straight eventually finishing 7th place.
Mr Robertson Senior stated that his son Tim did not get a lot of outside drives so he was mindful of ensuring that he gave the horse Aveross Blaze the best possible chance and drove it out to the winning post.

Mr Allison stated that Mr Robertson had received two warnings under the same rule in the past twelve months and that on this occasion Mr Robertson had clearly made an error of judgment.
Mr Allison’s main concern was that Mr Robertson continued to drive the horse out over the last 100 metres and this was why he was in front of the committee.
Reasons for Penalty:
The committee in fixing penalty believed the breach of the rule was at the lower end of the scale and also took into account Mr Robertson’s admittance of the breach.
