Dividends and stakes are to be paid as the horses crossed the line. 

Facts:

Mr Allison alleged that horse number 7 (SNAZZY JACCKA) placed 3rd by the Judge interfered with the chances of horse number 4 (FLUSHING MEADOWS) placed 4th by the Judge with 40 metres to run.

Judge’ placings were:

1st 1 SPIRIT OF ART
2nd 3 CHERS BETTOR BABE
3rd 7 SNAZZY JACCKA
4th 4 FLUSHING MEADOWS
5th 6 IDEAL TACT

The margin between 3rd and 4th was a length and a half.

Submissions for Decision:

Mr Allison demonstrated on the side-on and head-on videos that some 40 metres before the winning post the cart of SNAZZY JACCKA (Mr Williams) came into contact with the near hind leg of FLUSHING MEADOWS (Mr Lee), which was making a run on the outside of the field, with the result that that horse broke. He demonstrated that at the time Mr Williams moved wider on the track to take a run between FLUSHING MEADOWS and CHERS BETTOR BABE he had an advantage over Mr Lee. He demonstrated that there was also gradual outwards movement from the two horses inside Mr Williams at this time, namely CHERS BETTOR BABE and SPIRIT OF ART, although he believed that the latter horse was clear at the relevant time.

Mr Allison said that as SNAZZY JACCKA had an advantage over FLUSHING MEADOWS that that horse could move FLUSHING MEADOWS wider provided it was done in a safe and gradual manner. He emphasised the movement from SNAZZY JACCKA was not abrupt. He said CHERS BETTOR BABE had also shifted wider, looking for a run outside SPIRIT OF ART at the same time as Mr Williams had shifted out.

Mr Lee stated he believed his was the only horse that kept a straight line in the home straight. He said his horse had been hindered by SNAZZY JACCKA, was on one rein at the time, and had lost momentum before eventually breaking when there was contact. He believed that had he not suffered interference he would “probably have finished 3rd”. In response to a question from Mr Allison, he said he did not believe his horse had over-reacted to the outwards movement from SNAZZY JACCKA and that his horse was doing its best work at the time.

Mr Williams said Mr Larsen driving SPIRIT OF ART had dictated everyone’s line and that that horse had moved out 2 to 2 ½ horse widths in the home straight. He said once his horse found room and got going it was taking ground off the 2 horses in front of it and was finishing better than FLUSHING MEADOWS.

Mr Armour, the driver of CHERS BETTOR BABE, said he did not receive tightening from Mr Larsen although SPIRIT OF ART had dictated his line in the home straight. He said no one driver was to blame as the 3 horses (SPIRIT OF ART, CHERS BETTOR BABE and SNAZZY JACCKA) had simply gradually moved wider on the track when making their final runs. He pointed out he was also making ground on SPIRIT OF ART at the finish.

In summing up, Mr Allison said in his view Mr Larsen had not contributed to the incident and that Mr Armour had moved out a shade. He said Mr Williams when angling for a run did have an advantage on Mr Armour when there was contact. He said the issue for this committee was, “Was Mr Williams to blame?”

Reasons for Decision:

There has been contact between the cart of SNAZZY JACCKA and the near hind leg of FLUSHING MEADOWS. This is as Mr Williams was making a run between FLUSHING MEADOWS and CHERS BETTOR BABE. He always had an advantage over Mr Lee. The outwards movement was gradual and was exacerbated by the fact that Mr Armour, who was racing on the inner of SNAZZY JACCKA had also moved out gradually when looking to take a run outside SPIRIT OF ART. In simple terms there was gradual outwards movement from 3 horses, not just from SNAZZY JACCKA. Although Mr Lee was mounting a run on the outside of the track, that horse, which was running straight, was not taking sufficient ground off the 2 leading horses that it would have finished ahead of them and, once outside CHERS BETTOR BABE, SNAZZY JACCKA finished on strongly and from that time was finishing as well as, if not better than, FLUSHING MEADOWS before that horse broke. We do not believe that this was due solely to the progress of FLUSHING MEADOWS being hindered by SNAZZY JACCKA, as Mr Lee has alleged.

In exercising our discretion to leave the placings as the horses crossed the line, we are not satisfied that the interference suffered by FLUSHING MEADOWS was solely caused by SNAZZY JACCKA, nor that the outwards movement by SNAZZY JACCKA was anything but gradual. In addition, while the progress of FLUSHING MEADOWS was clearly interrupted, this was very close to the line, and we are of the view that SNAZZY JACCKA would still have finished ahead of FLUSHING MEADOWS had contact not occurred.
