An information was lodged by Stipendiary Steward Mr P Knowles instigating a protest lodged under Rule 869 (8) (b) - with approximately 950 metres to run DREAMAWAY VOGUE, driven by Mr S G Dickson, hung inwards checking MYSTICAL MISS, driven by Mr C J Barron, causing MYSTICAL MISS to break, losing several lengths.
--Stipendiary Steward Mr C Allison used video clips to highlight the alleged incident. Pointing out that as the field was about to leave the straight, MYSTICAL MISS, driven by Mr Barron, was travelling in the one / one. DREAMAWAY VOGUE, driven by Mr Dickson, racing 3 wide, allegedly moved inwards, making contact with MYSTICAL MISS, causing that horse to break and lose several lengths.
--Mr Dickson, in his evidence, stated that in his opinion, the trailing horse STARTLING EASTON, (no 1), contributed to the problem by moving outwards on the turn - causing MYSTICAL MISS to move outwards on to DREAMAWAY VOGUE. Mr Dickson did admit to making contact with MYSTICAL MISS.
--Mr Barron, in his evidence, stated that the outside horse DREAMAWAY VOGUE did hang down "in a minor way", made contact to his horse's back foot, causing it to break and lose several lengths.
--Mr Stapleton, trainer of DREAMAWAY VOGUE, supported his driver's comments - he felt that the trailing horse had moved out slightly, contributing to the incident.
--Mr Knowles summarised by using video film. He stated that in his opinion DREAMAWAY VOGUE had hung badly, made slight contact and had caused the problem. He also stated that in his opinion the movement of the trailing horse, STARTLING EASTON, no 1, had occurred but only after the incident which caused MYSTICAL MISS, no 5, to break.
--DECISION & REASONS
--It is my decision to uphold the protest. Accordingly, the fourth horse DREAMAWAY VOGUE, driven by Mr S G Dickson, to be relegated to ninth placing. Horse no. 8 NAVARNA HOLMET to be promoted to fourth placing.

- It is my opinion that contact was made by DREAMAWAY VOGUE causing MYSTICAL MISS, driven by Mr Barron, to break. --
- Mr Barron gave clear evidence that it was this contact that caused the problem. His horse lost a good position and all chance. --
- The outward movement of STARTLING EASTON was not a factor.
