An information was lodged by Stipendiary Steward Mr P T Knowles, instigating a protest lodged under Rule 869 (8) (b) - MAKAREWA STEPH driven by Mr B J Morris, broke and checked CASTLETON'S JEWEL

An information was lodged by Stipendiary Steward Mr P T Knowles, instigating a protest lodged under Rule 869 (8) (b) - MAKAREWA STEPH driven by Mr B J Morris, broke and checked CASTLETON'S JEWEL causing CASTLETON'S JEWEL to lose considerable ground.

Mr Knowles commenced proceedings by using video to highlight the alleged incident at the start. He pointed out where MAKAREWA STEPH, no. 4, driven by Mr B Morris, had swung sideways into the path of no. 10, CASTLETON'S JEWEL - allegedly causing that horse to break / check and lose ground.

Mr N Williamson, in giving evidence, used video to explain that his horse CASTLETON'S JEWEL had started out of position (because it was fractious) and was actually commencing to break - just before MAKAREWA STEPH swung sideways, taking his line.

Mr Morris confirmed this sequence, stating that no. 5 HEART THROB HEST had also momentarily checked his horse, adding to the confusion.

Mr Williamson was adamant that his horse was already in a break and had in fact broken again immediately after settling.

DECISION & REASONS :

My decision is to dismiss the protest and to allow all placings as the horses finished to remain.

  1. Clear video evidence of the incident which showed that CASTLETON'S JEWEL, no. 10, had indeed broken whilst clear of any interference.

  3. Evidence given by both drivers involved, Mr Williamson (CASTLETON'S JEWEL) and Mr Morris (MAKAREWA STEPH) which confirmed my viewing of the film.
