Mr T Robertson was suspended from the conclusion of racing on Monday 24th January 2011 until the conclusion of racing on Friday 11th February 2011.
Charge:
At the conclusion of race 5 the South Port NZ LTD 4yr Older Drivers Mobile Pace, an information was lodged by Stipendiary Steward Mr N. M. Ydgren alleging that with approximately 2300metres remaining Mr T. Robertson (Junior Horseman) allowed his drive (Superior Jasper) to shift down the track when not sufficiently clear of Hugo Seelster (C. Ferguson), causing this horse to gallop and check both Rennie Sivad (C. Hanna) and Ringwraith (A. Sanderson).
Facts:
Stipendiary Steward Mr Allison showed the committee , head on , side on and back on video clips of the alleged incident, highlighting in his opinion the movement of Superior Jasper onto Hugo Seelster when not sufficiently clear, causing Hugo Seelster to break and lose its chance.
Submissions for Decision:
Mr Ydgren asked Mr Ferguson (Hugo Seelster) to state his version of the incident, Mr Ferguson stated that Mr T Robertson came across in front of me and got my horse’s front leg.
Mr Ferguson also stated that he yelled out to Mr Robertson to “ Give him some room”. Mr Ferguson stated that his horse did not contribute to the incident.
Mr G Lee (Trainer of Hugo Seelster) stated that in his opinion, it was clear cut from the video clips that Superior Jasper had moved down onto Hugo Seelster when he was not clear.
Mr T Robertson stated that he had come around the corner and that he didn’t “pull down”. I looked and there was room he said.
Mr L Robertson stated that he did not believe that Superior Jasper had come into contact with Hugo Seelster. Mr L Robertson also stated he believed Hugo Seelster galloped without any contact being made at all and that he shied on his own accord.
Mr Lee disputed Mr L Robertson’s claims.
Reasons for Decision:
The committee was satisfied a breach of the rule has occurred.
The video clips of the incident were compelling in the committee’s opinion. Clearly Superior Jasper has not been clear of Hugo Seelster when moving inwards, hitting the front legs of Hugo Seelster causing that horse to break and lose it’s chance. Hugo Seelster in turn checked both Rennie Sivad and Ringwraith.
Submissions for Penalty:
Mr Ydgren stated that Mr T Robertson was a Junior Horseman and had twelve race day drives this season, and he had no previous breaches under this rule.
Mr Ydgren believed the breach of carelessness was mid range to high; noting that three horses had been affected.
Mr L Robertson said that Mr T Robertson did not earn a lot as a Junior Horseman, and that he currently had five horses in training all who would be driven by Mr T Robertson on race days.
Mr T Robertson confirmed his horses would only race at Southland Meetings, and that he had no commitments to drive outside Southland.
Reasons for Penalty:
The committee considered all submissions and on this occasion a suspension was considered to be the best solution.
