At the conclusion of Race 1 The Miss Pegasus by Pegasus Spur trot a protest was lodged by Stipendiary Steward Mr N. McIntyre alleging that Love The Moment (G. Lee) broke inside the final 50 metres and was lapped on to Hengoen (1) P. Williamson and O’Driscoll (11) R. Swain.

The Rule Reads (870/5):
Notwithstanding the provisions of sub-rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any other horse in the correct gait shall be placed by the Judicial Committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then (subject to Rule 869 (8)) such relegation of the horse shall be at discretion of the Judicial Committee.

Stipendiary Steward Mr McIntyre used the head on and side on video clips to highlight Love The Moment (second placed horse), breaking inside the last 50 metres of the race and being lapped on to Hengroen (third placed horse) and O’Driscoll (the fourth placed horse).
Mr G. Lee the trainer and driver of Love The Moment did not contest the protest, however he wished it to be recorded that his horse broke because he drove his horse out as required by the rules. In his opinion the horse would not have broken if he had taken a hold of it.
Reasons for Decision:
The video clips show clearly that Love The Moment was lapped on and accordingly the committee upholds the protest and Love The Moment is relegated from second placing to fourth placing.
