Facts:
Following the running of race 2, the Willy’s Flooring Limited Trot, a Protest Information was lodged by Stipendiary Steward, Mr Mulcay alleging PEGASUS HANOVER galloped in excess of 50 metres in the final 200 metres. He was seeking the disqualification of PEGASUS HANOVER under r 870(3) and 1003(2).
Rule 870(3) reads: that any horse which breaks from its gait shall promptly retain its gait.
The Breaking Horse Regulations part (b) reads: that any horse that breaks from its gait within the final 200 metres and continues on in the break for a distance of 50 metres or greater, shall be deemed to be in breach of Rule 870(3) in that it has failed to promptly regain its proper gait.
Rule 1003(2) reads: Every horse which commits a Breach of any Rule shall be liable for the following penalties:-
(a) to be disqualified or scratched from any race.

Submissions for Decision:
With the aid of the videos Mr Mulcay demonstrated that PEGASUS HANOVER driven by Ms Graham was running approximately 4th and on the peg line. The horse galloped at the 200 metre mark and continued in a strong gallop to the finish line. PEGASUS HANOVER was placed third by the judge. He was seeking the disqualification of the horse.
Ms Graham signed the information and indicated she did not contest the Protest.
Reasons for Decision:
After viewing the video the Committee was satisfied that PEGASUS HANOVER was in breach of r 870(3) in that it failed to regain it proper gait promptly and had galloped in excess of 50 metres. As the horse had gained an advantage over the rest of the field it was disqualified from third placing pursuant to r 1003(2).
