Mr MacDonald admitted the breach and it is found proved.

Facts:

Following the running of race 8 the Craig Heyrick At Harcourts Mobile Pace Stewards charged Mr A MacDonald with a breach of r869 (7A) (c) in that he allowed his horse “DOUBT ME NOT to shift inwards causing Ivana Legacy to contact and protrude inside marker pegs.”

Rule 869 (7A) (c) reads: 

               Every horseman who moves inwards shall ensure:

That the movement does not cause any other horseman, horse or sulky to contact any track marker or protrude inside the marker line.

Mr MacDonald appeared at the hearing and admitted the charge.

Mr Munro, with the use of the videos, said that Mr MacDonald (DOUBT ME NOT) was in the lead as the field headed down the back straight with approx. 700m to run. He said about the 600m mark Mr MacDonald allowed his horse to shift outwards about one cart width. Nearing the 500m mark Mr Armour (IVANA LEGACY) moved forward into the lead keeping DOUBT ME NOT in the one-out position. Mr MacDonald then allowed his horse to shift inwards and forced IVANA LEGACY over several pylons. Mr MacDonald continued to put pressure on Ivana Legacy around the top bend with that horse being forced onto track markers about the 230m mark.

Mr MacDonald stated his horse did drift out down the back straight, and he was surprised to see Mr Armour shift forward and keep him out. He said the sulkies in the USA were wider and Mr Armour’s driving manoeuvre did not happen in the USA. He admitted putting pressure on Mr Armour’s horse from that point. 

Submissions for Penalty:

Mr Munro stated the JCA Penalty Guide recommended a starting point of $300. He said Mr MacDonald had an excellent and clear record in Canada and he sought a fine of $300.

Mr MacDonald accepted he was at fault and made no specific submission as to penalty.

Reasons for Penalty:

Mr MacDonald was charged with a breach of 869 (7A) (c) forcing another runner over marker pegs between the 500m and 200m marks. The Stewards sought a penalty of $300. Mr MacDonald admitted the breach and has an excellent record. We take into account that while a horse was forced onto pegs it was not disadvantaged. A fine at the lower end of the scale is appropriate.
