Decision: -- Under Rule 862 (2) It was alleged that in the run up behind the mobile, Mr Herlihy, drawn to be a No.6 on the 2nd line, had not maintained his correct position. Under Rule 862 (2) It was alleged that in the run up behind the mobile, Mr Herlihy, drawn to be a No.6 on the 2nd line, had not maintained his correct position. Stipendiary Steward Mr N McIntyre used video film to highlight the alleged incident. He was assisted by Stipendiary Steward Mr Allison. Mr McIntyre did however stress that the front line horses were racing very loosely on the gate and that three of the 2nd line horses were racing some lengths off the gate when released. This meant that there were at least 2 spaces vacant inside Mr Herlihy's horse. Starter Mr Ward gave evidence that all the correct procedures were followed prior to the start and correct instructions were given. He did state that it was an untidy start. Mr Herlihy gave evidence that he believed that he was holding his correct position until the point of release, made difficult because the two horses drawn inside him were unable to hold their correct position. He also stated that the horse immediately in front of him was racing roughly on release and he was forced to steer inwards to gain a clear path. Trainer, Mr Kirk Larsen made a similar representation, that it was indeed a messy start and that with the front horses loosely on the gate, and some horses not taking up their correct positions on the second line, Mr Herlihy was in actual fact holding the position he was entitled to on the second line. Hearing was adjourned to allow time to review film evidence and make a decision. On reconvening the meeting I gave my decision to dismiss the protest. REASONS: Mr Herlihy in the view of the committee had made every reasonable effort to start from the correct position All parties did agree that the start was less than perfect. These factors all contributed to give the committee sufficient reason to give benefit of any doubt to Mr Herlihy. A Dennis Chairman
