Mr Ramage was fined the sum of $250.00 and was given a clear warning that any further breach under this rule would incur a more severe penalty.
Charge:
At the conclusion of race 8 the Super Feature Finals Day 30 April Mobile Pace an information (69380) was laid by Stipendiary Steward (Mr N G McIntyre) under rule 869(2)(a) alleging that C B Ramage (All For D B) used his whip excessively over the final stages.
Mr Ramage did not admit the breach.
Facts:
Stipendiary Steward (Mr McIntyre) showed the committee several video clips of the alleged incident highlighting in his opinion Mr Ramage striking his horse(All For D B) from the top of the straight to the winning post continuously on twenty five occasions.
Submissions for Decision:
Mr Ramage stated that he did not believe the horse All For D B would have finished in third placing if he did not drive it out the way he did.
Mr Ramage initially did not believe that he had struck the horse twenty five times however after viewing the video clips several more times he then agreed that this was the case.
Reasons for Decision:
The committee was satisfied that a clear breach of the rule had occurred. The video evidence was conclusive that Mr Ramage had struck the horse All For D B form the top of the straight to the winning post continuously and on twenty five occasions.

Stipendiary Steward Mr McIntyre stated that Mr Ramage had no previous breaches under this rule in the past twelve months.
Mr Ramage stated that he was having one or two drives on a race day and that the racing team that he was involved with was increasing.
Mr Ramage also stated that a suspension may result in him losing some race day drives in the future if another driver was to replace him and was to be successful.
Reasons for Penalty:
In fixing penalty we took into account mitigating factors of, Mr Ramage's good driving record and his limited drives on race day. The aggravating factor was that the breach was in the mid range.
