Facts:
At the conclusion of race 2 the Mc Knight & Brown Pace Stipendiary Steward Mr N G McIntyre asked the Judicial Committee for a ruling under rule 213(1)(1) being that Lively Step was denied a fair start.
Submissions for Decision:
Stipendiary Steward Mr N McIntyre showed the committee several video clips of the alleged incident highlighting Lively Step standing in the unruly position number two.
Mr McIntyre highlighted the starter’s assistant attempting to turn the head of Lively Step and to straighten the horse up, the horse resisting and backing out of line.
The starter Mr N Popham stated that he had looked at the field several times and initially number three Seldom Getit (S Lock) was playing up and then once he was brought into line he let the field go as he believed they were ready to do so.
Mr Thomas Horseman of Lively Step stated that initially the horses waited a long time to be released and that he was given no help. If he had waited another two seconds he would have gone away.
Reasons for Decision:
The committee was satisfied that Lively Step did not go away with the rest of the field because of his barrier manners.
