Facts:

Following the running of Race 2, the Topline Muscle From Hanleys Formula Mobile Pace, an Information was filed by Mr Tidmarsh, alleging that Mr Robertson, the driver of LADY’S LASS, used his whip outside the regulations over the final 400 metres.”

Rule 869 provides as follows:

(2) No horseman shall during any race use a whip in a manner in contravention of the Use of the Whip Regulations made by the Board.

The Use of the Whip Regulations provide:

(b) No horseman is permitted to use their whip in a striking motion on more than ten occasions inside the final 400 metres. This is inclusive of “backhanders” and the use applies to the horse, harness and/or sulky.

Mr Robertson admitted the breach and did not attend the hearing.

Mr Tidmarsh, with the aid of the video replays, stated Mr Robertson was in the three-wide line as the field passed the final 400m mark. He said from the 300m mark to the finish Mr Robertson used his whip 12 times. All the strike were free of the rein. He said when spoken to, Mr Robertson admitted the breach and did not wish to attend the hearing.

Submissions for Penalty:

Mr Tidmarsh stated Mr Robertson had two prior breaches of the whip rule inside the last 12 months, but this was his first breach of the rule under the new penalty guidelines. He said the number of strikes with the whip (12) fell inside the lower scale and he sought a fine of $200.

Reasons for Penalty:

Mr Robertson admitted the breach and had a clear record under the new whip guidelines. A fine at the lower end of the scale is appropriate.
