Mr T R Robertson was suspended from the conclusion of racing on Thursday 22nd December 2011 until the conclusion of racing on Tuesday 27th December 2011 (effectively one driving day).
Charge:
At the conclusion of Race 1 Mico Plumbing & Pipelines Mobile Trot, an information was lodged by Stipendiary Steward, Mr C J Allison alleging that Mr T R Robertson Junior permitted Gentle Georgia to start from the mobile barrier not from its correct position of unruly (2).
Facts:
Stipendiary Steward, Mr Allison showed the Committee several video clips of the alleged incident highlighting Gentle Georgia starting from position (6) on the front line of the mobile when the horse should have been starting from the second line, no further out than position (5).
Mr Allison stated that it was fortunate that the horse did not run in a dividend or stake bearing placing.
Submissions for Decision:
Mr T Robertson Junior (Gentle Georgia) stated that he had made an error of judgement as he was unsure of the rule and thought that he could start from the front line in the unruly position (2).
Mr Allison stated that it was a basic requirement that a Driver should know what position his horse is starting in and that the official race day starter was not responsible to insure horseman had their horses in the correct starting position.
Reasons for Decision:
The Committee was satisfied a breach of the rule had occurred and that the video evidence was compelling clearly showing Gentle Georgia starting from the incorrect position on the front line.
Submissions for Penalty:
Stipendiary Steward, Mr Allison informed the Committee that Mr T R Robertson Junior had received a fine of $250.00 at the Wairio Meeting on the 16/10/11 under the same rule. Mr Allison recommended that a penalty, not less than the sum of $250.00 would be appropriate in this instance.
Mr Robertson Junior stated that a monetary penalty would be difficult in his current financial situation.

The Committee considered both Mr Allison's and Mr Robertson's submissions and thought a suspension of the horseman's license would be appropriate on this occasion.
