Decision:

A protest was lodged following the running of Race 2 by Stipendiary Steward Mr C Allison, into fourth placegetter BOSWORTH (1) alleging a breach of Rule 870 (5) in that BOSWORTH broke short of the winning post and was lapped on

A protest was lodged following the running of Race 2 by Stipendiary Steward Mr C Allison, into fourth placegetter BOSWORTH (1) alleging a breach of Rule 870 (5) in that BOSWORTH broke short of the winning post and was lapped on by the fifth placed horse TORASION (10).

The connections of BOSWORTH were represented by the trainer, Mr W Heads.

Video footage shown by Mr Knowles shows BOSWORTH breaking approximately 25 metres from the finish and galloping across the finish line.  In doing so, BOSWORTH is seen to be lapped on by fifth placegetter TORASION, the margin between 4th and 5th being ½ neck.

Mr Heads accepted that BOSWORTH had been lapped on, however maintained that his horse had been hampered by the breaking horse in front of BOSWORTH and that had his horse not had to take evasive action then it would have remained in its correct gait and finished 4th.

Mr Allison made further comment to the effect that stewards had spoken to BOSWORTH’s driver, Mr N Williamson, who advised that the horse should not have galloped under the circumstances.

The committee adjourned to discuss the discretion available to it to relegate under Rule 870 (5) if the fact that the horse had galloped as a result of interference to it.

--

On resuming the hearing the committee upheld the protest on the basis that BOSWORTH broke more through its inexperience than any interference it may have suffered.  BOSWORTH is therefore relegated to fifth and TORASION promoted to fourth.
