Decision:

Following the running of Race 2 – The American Ideal World Champion Pedigree Trot, a protest was lodged by Stipendiary Steward Mr C J Allison, alleging a breach of Rule 870 (3) and (4) and the Breaking Horse Regulations in that with approximately 60 m to run WATCH ROSE TROT (Peter Ferguson) broke and regained its correct gait just prior to the finish line.



Following the running of Race 2 – The American Ideal World Champion Pedigree Trot, a protest was lodged by Stipendiary Steward Mr C J Allison, alleging a breach of Rule 870 (3) and (4) and the Breaking Horse Regulations in that with approximately 60 m to run WATCH ROSE TROT (Peter Ferguson) broke and regained its correct gait just prior to the finish line.

Mr Allison used video footage to point out where the horse WATCH ROSE TROT went into a break and exactly where that same horse regained its correct gait.  Mr Allison suggested that the break occurred at about the 60m mark, continued for approximately 50m and then began to trot again some distance prior to the finish line.  He commented that it was “touch and go” whether WATCH ROSE TROT actually galloped in excess of 50m.

Mr Ferguson agreed with this summation and added that his horse deserved the benefit of any doubt.

The committee adjourned to review the tapes and make our decision.

DECISION

--

At the resumption of the protest hearing the committee dismissed the protest, the over-riding reason being that it was impossible to determine accurately if in fact WATCH ROSE TROT had galloped in excess of 50 m.  Placings to stand as the horses crossed the line.
