Her record is good. Taking into account the gravity of the breach and its consequences, we uplift by one day from the 3-day JCA starting point in the Penalty Guide to 4 days. After a 1-day discount for admission and record, the penalty is 3 days.
Drivers are declared for Waikouaiti on Sunday. Ms Cameron is suspended from end of that meeting on 23 February up to and including 1 March. This is 3 days.
Facts:
Mr Munro, Stipendiary Steward, alleged that Ms Cameron (BONNY’S GEM) drove carelessly near the 2000 metres in race 6 when shifting inwards when not clear of HAZER (T Larsen) which was taken inwards checking CHEDDAR MADE BETA (M Hurrell) which broke.
Mr McIntyre demonstrated the alleged breach on the videos. He pointed out Ms Cameron who was racing 3-wide mid-field. He said she was trying to follow Mr Morrison who was shifting to a 2-wide position. There were 2 horses to her inside, whereas Mr Morrison only had one. The consequence of the respondent’s actions was that Mr Hurrell was forced over pylons and his horse broke.
Mr Williamson said Mr Larsen was “a big factor” in the incident. He said Mr Larsen had never yelled for room when he saw Ms Cameron shifting in. He said the carts of Mr Larsen and Ms Cameron never touched, only those of Mr Hurrell and Mr Larsen.
Mr Munro responded that the Stewards accepted Ms Cameron had taken corrective action, but it was too late.
When questioned Ms Cameron said she did not realise there were 2 horses to her inside when she shifted; she thought there was only the one.
Submissions for Penalty:
Mr Munro produced Ms Cameron’s record. This is her first season of driving. She has had 41 drives. Her record is clear under the careless driving rule. Mr Munro said one horse affected by the respondent’s actions weakened out, the other was hampered. He asked for a 3-day suspension.
Mr Williamson submitted some blame attached to Mr Larsen and that the breach was at the lower end. Ms Cameron stated she believed a 3-day suspension was “fair”.
Reasons for Penalty:
Ms Cameron has shifted in following Mr Morrison to a 2-wide position when then was insufficient room for her to do so with safety. Two horses were inconvenienced, with one, CHEDDAR MADE BETA, breaking when it was pushed over the pylons. Ms Cameron should have seen that Mr Hurrell was to the inside of Mr Larsen. She did not and, as a consequence, she was careless.
