Evidence:

A Request for a Ruling was heard at the Winton Harness meeting on Sunday 19th April, as to whether Mr N Williamson could drive MY MATE OZZ (trained by Mr M Swain) with BOOSTER being driven by owner Mr R McIlwrick, which Mr N Williamson trains.

The rule reads 503(1):

The owner or trainer of a horse in a race shall not drive any other horse in the race, except with the permission of the Stipendiary Steward.

Submission for Decision:

Mr Allison clarified for the Committee that he was instructed by the Racing Integrity Unit not to allow Mr Williamson’s request to drive MY MATE OZZ, trained by Mr M Swain, at the Invercargill meeting on Tuesday 21st April 2015. Mr Allison reinforced that it may be seen as an integrity issue within the industry if Mr Williamson drove a horse from an outside stable, when he had a horse entered in the same race. Mr Allison stated that he has no issue regarding Mr McIlwrick's or Mr Williamson's integrity around this issue.

Mr Wallis, when questioned, stated that there had been a similar request in the North Island when Mr Cullen had driven a horse he owned and Mr B Mangos, who trains the horse has driven another horse not from his stable.

Mr G Lee stated that he had driven on several occasions, in recent times, horses from outside stables when his brother who he co-trains with had driven a stable runner. He said the stipendiary stewards had granted this and had no issues.

Mr Williamson stated that Mr McIlwrick was an employee of his and owned the horse BOOSTER, which he had driven on a regular basis. Mr Williamson said he also regularly drove for Mr Swain and simply saw no issues of his or Mr McIlwrick's integrity being in question.

Reasons for Decision:

The committee has not received any formal notification of a change to the rule as it is written or seen any amendment to the rule. There has been clear evidence in the past that stipendiary stewards have the right to use their discretion under this rule which was supported by Mr Allison.

Decision:

The Committee under the current rule is satisfied that neither Mr Williamson's or Mr McIlwrick's integrity is in question and as a result we allow Mr Williamson to drive MY MATE OZZ at the Invercargill Harness meeting on Tuesday 21st April.
