The protest was upheld and VICAR SIVAD (C Barron) was relegated from fourth placing to tenth placing.

CHIEF KAPAI (C Hanna) was promoted from tenth placing to ninth placing.

Facts:

At the conclusion of race 2 Bettor's Delight At Woodlands Stud 3YO Mobile Pace a protest was lodged by Stipendiary Steward Mr C J Allison into the fourth placed horse by the judge VICAR SIVAD (C Barron) under rule 869(8)(b) alleging that with approximately 1200 metres to run VICAR SIVAD (C Barron) jumped and broke causing a significant check to the trailing CHIEF KAPAI (C Hanna) who broke and lost its chance.

Submissions for Decision:

Stipendiary Steward Mr Allison showed the Committee several video clips of the alleged incident highlighting the horse VICAR SIVAD jumping and then breaking at about the 1200 metre mark. As a result of this the trailing horse CHIEF KAPAI was checked severely and lost its chance.

Mr Allison stated that it was his belief that no driver was at fault and that the horse may have jumped due to the slushy track conditions or as a result of the lap bell ringing at the point of the incident.

Mr Hanna stated that CHIEF KAPAI was in the trailing position and basically had no where to go when VICAR SIVAD jumped and then broke. Mr Hanna then stated his horse lost valuable ground and effectively lost its chance.

Mr C Barron stated that he believed his horse had been frightened by the early ringing of the lap bell causing him to jump, or that he had simply jumped at a shadow on the track. Mr Barron did not contest the fact that his horse had caused the incident and that CHIEF KAPAI'S chances were basically extinguished.

Reasons for Decision:

The Committee was satisfied that VICAR SIVAD had broken free of interference and had severely checked the trailing horse CHIEF KAPAI causing that horse to also break and lose its chance. The video evidence was conclusive along with the verbal evidence of Mr C Barron and Mr Hanna.
