The protest was upheld and Cool Son was relegated from 2nd placing to 3rd placing. The amended placings are as follows:

1st Sixty Plus (3)

2nd Zachary Smith (2)

3rd Cool Son (11)

4th Hope and Pray (6)

It was ordered that dividends and stakes be paid in accordance with the amended results.

Facts:

Following the running of Race 1 The Russell Dixon and Steve Hawke Trot an information instigating a protest was lodged by Stipendiary Steward Mr N Yogren, alleging that the second placed horse Cool Son (A Beck) broke in the run home.

1st Sixty Plus (3) H Hunter

2nd Cool Son (11) A Beck

3rd Zachary Smith (2) K Barclay

4th Hope and Pray (6) N Williamson

The rule reads 870(5):

Notwithstanding the provisions of sub rule (4) hereof any horse which is not in the correct gait when its nose reaches the finishing line and which is lapped on by any horse or horses in the correct gait shall be placed by the judicial committee behind such horse or horses provided that where such first mentioned horse is not in its correct gait as a result of interference to such horse or its horseman, then subject to rule 869(8) such relegation of the horse shall be at the discretion of the judicial committee.

The margin between the second placed horse Cool Son and the third placed horse Zachary Smith (K Barclay) was a neck.

Mr A Beck representing the connections of Cool Son did not contest the protest, and informed the Stewards he did not wish to be present at the hearing.

Submissions for Decision:

Stipendiary Steward Mr N Ydgren showed the committee several video clips of the alleged incident, which clearly showed Cool Son breaking just after the 50 metre pylon from the winning post, for approximately forty five metres, and being clearly lapped on to the third placed horse Zachary Smith. Mr Ydgren submitted the Stewards were seeking relegation of Cool Son from 2nd to 3rd placing.

Reasons for Decision:

I carefully considered the evidence given and the video coverage of the incident and I was satisfied that Cool Son had broken for about 45 metres and was lapped on by the third horse Zachary Smith at the winning post.

As a result the protest was upheld.
